Documents Required for Divorce in India

The documents required for divorce in India are, at the core, proof of marriage, identity and address proof for both spouses, photographs, and evidence supporting your case, such as proof of separation for a mutual divorce or proof of the ground for a contested one. If maintenance or alimony is involved, both sides must also disclose income, assets and liabilities. This checklist explains what to gather, why each item matters, and what to do if something is missing, with notes for filing in Bangalore.

Documents Required for Divorce in India: The Core Checklist

There is no single official list that applies to every court, and Family Courts can ask for additional papers depending on the case. But the following documents are needed in almost every petition, whether filed under the Hindu Marriage Act, 1955, the Special Marriage Act, 1954 or another personal law.

What if the marriage was never registered?

Registration is not a condition for a valid Hindu marriage. Section 8 of the Hindu Marriage Act allows states to make registration rules, but it expressly says that failure to register does not affect the validity of the marriage. If you have no certificate, the marriage can be proved through the wedding invitation card, photographs or video of the ceremony, the priest or witnesses, and later records such as joint bank accounts, a passport showing the spouse’s name or children’s birth certificates. Marriages under the Special Marriage Act are registered by the Marriage Officer, so a certified copy of the entry should be available.

Additional Documents for a Mutual Consent Divorce

For a joint petition under Section 13B, the court will look for:

  • Proof of separation for at least one year, such as separate rental agreements, address change records, or a clear description in the petition and affidavits.
  • The settlement agreement or memorandum of understanding, covering alimony, return of stridhan, custody and visitation, and property.
  • Details of any pending cases between the spouses, and how they will be withdrawn.
  • Affidavits of both spouses supporting the first and second motions (see how to write an affidavit for divorce).
  • Waiver application papers, if you ask the court to waive the six-month cooling-off period.

For how these fit into the process, see our comparison of mutual divorce vs contested divorce and our guide to how long divorce takes in India. If you both agree, our mutual divorce lawyers in Bangalore can prepare the joint petition.

Additional Documents for a Contested Divorce

In a contested case, documents are your evidence. What you need depends on the ground you rely on, explained in our guide to the grounds for divorce in India:

  • Cruelty: messages, emails, social media posts, medical records, police complaints, and a dated diary of incidents.
  • Desertion: proof of when the spouse left, attempts to reconcile, legal notices, and evidence of continued separation for two years.
  • Adultery: circumstantial evidence such as communications, travel records or photographs, gathered lawfully.
  • Mental disorder: medical records and expert evidence.
  • Earlier decree: certified copy of the judicial separation or restitution decree, and proof of no cohabitation since.

Make sure evidence is obtained lawfully. Accessing a spouse’s phone or accounts without permission can create legal problems of its own, and courts may question how evidence was collected.

Financial Documents for Maintenance and Alimony

Where maintenance, interim maintenance under Section 24 of the Hindu Marriage Act, or permanent alimony under Section 25 is claimed, finances become central. In Rajnesh v. Neha (2020), the Supreme Court made it mandatory for both parties in maintenance proceedings to file an affidavit disclosing their assets and liabilities in a prescribed format. Gather these early:

Both sides should be accurate. Concealing income or assets can damage credibility and may lead to adverse orders. If you also claim maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 125 CrPC), the same financial records will be useful. A specialist alimony lawyer in Bangalore can help prepare the disclosure affidavit and supporting documents.

Documents Relating to Children

  • Birth certificates of the children.
  • School admission records, fee receipts and report cards.
  • Medical records and any special needs documentation.
  • Proof of who has been the primary caregiver, such as school communications.
  • A proposed parenting plan or visitation schedule, if one is agreed.

Documents for Special Situations

When one spouse lives abroad

Keep a copy of the spouse’s passport and visa details, foreign address, and any evidence of communications. If you cannot attend in person, a properly executed power of attorney or arrangements for video conferencing may be needed, subject to the court’s permission. Our guide to NRI divorce in India explains the extra steps when one spouse lives abroad.

When the spouse cannot be found

Keep proof of attempts to trace and serve the spouse, such as returned postal covers. This supports a request for substituted service and, if the spouse does not appear, allows the court to proceed, as explained in our guide to ex parte divorce in India.

Earlier cases

Bring certified copies of any earlier orders or pending case papers, such as domestic violence proceedings, maintenance orders or criminal complaints.

Common Document Mistakes to Avoid

  • Inconsistent dates and addresses. If the date of separation or your address differs between the petition, affidavits and documents, the other side will use it in cross-examination.
  • Understating or overstating income. Courts compare disclosure affidavits with bank statements and tax returns, and unexplained gaps hurt credibility.
  • Relying only on screenshots. Keep the original device or account data, and the full conversation, not selected messages.
  • Losing track of originals. Keep a simple register of which originals are with you, your lawyer or the court.
  • Leaving children’s papers to the end. Custody and maintenance questions often arise early, so have these ready from the start.

Practical Tips for Filing in Bangalore

Petitions in Bangalore Urban are filed at the Family Court complex near Lalbagh Main Gate on Siddaiah Road. Keep originals safe and file self-attested photocopies; the court may ask to see originals at the time of evidence. Organise documents in date order with an index, as this makes drafting quicker and cross-examination smoother. If you cannot afford a lawyer, the Karnataka State Legal Services Authority may provide free legal aid to eligible applicants. How this guide was prepared

This guide is based on the bare acts published on India Code and on judgments of the Supreme Court of India and the Karnataka High Court. Section numbers, case citations and time limits were fact-checked in October 2026, and criminal-law references use the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS) in force since 1 July 2024. Frequently Asked Questions

Can I file for divorce without a marriage certificate?

Yes. A marriage certificate is the easiest proof, but the marriage can also be proved by the wedding invitation, photographs, witnesses and other records. Your petition should explain why no certificate is available.

Do I need my spouse’s documents to file a contested divorce?

No. You need your spouse’s correct address for service of notice, but not their documents. You can describe their income and assets as best you know, and the court can direct disclosure.

Are WhatsApp messages accepted as evidence in divorce cases?

Electronic records can be used as evidence if properly produced. They are now governed by the Bharatiya Sakshya Adhiniyam, 2023, which replaced the Indian Evidence Act and requires a certificate for electronic records. Your lawyer will advise on the format.

Do both spouses need to give documents in a mutual divorce?

Yes. Both are petitioners in a joint petition, so both provide identity and address proof, photographs, and sign the petition, affidavits and settlement.

Should I submit original documents to the court?

Usually you file copies and keep originals for production when the court asks, often during evidence. Never hand over originals without getting an acknowledgment.

Getting your documents right at the start avoids delays and weak evidence later. If you want a checklist tailored to your case, consult one of the experienced female divorce lawyers in Bangalore or any lawyer you are comfortable with.
